SHORT ANSWER
If a work permit application is denied, an appeal may be filed with the Ministry within 30 days of the decision being served. This tool explains what the denial code means and identifies which deficiencies need to be addressed.
To be done before filing an objection
You should not file an objection before the grounds for rejection have been read. The most common reasons include workplace conditions, the number of Turkish employees, salary, job description, and missing documentation.
If the issue can be resolved, resubmitting the application is also an option. However, if the same deficiencies persist, there is a risk that the new application will also be rejected.
Time Frames
The appeal period is 30 days from the date of notification of the decision to reject, revoke, refuse to extend, or terminate. If the appeal is denied, the administrative judicial process may be pursued.
When a work permit becomes invalid, the right of residence associated with it also ends. It should not be assumed that everyone is automatically granted an additional 10-day right to remain.
All time periods on the work permit pageA refusal also affects the right to residence
The right of residence based on a work permit ends when the work permit becomes invalid. If you have a separate, valid residence permit that is independent of your work permit, its status will be evaluated separately.
The safest approach is to begin the process of transitioning to the appropriate residence permit before your work permit expires. The Immigration Authority states that you can apply for a residence permit starting 60 days before your work permit expires.
Official sources do not confirm that a 10-day automatic application period is generally granted to everyone after leaving the Social Security Institution (SGK).
